BreakLoop Terms of Use

These Terms of Use (the “Terms”) govern your access to and use of BreakLoop, including the BreakLoop mobile application, the BreakLoop website, account and cloud services, beta and TestFlight access, premium features, and purchases made directly through BreakLoop (collectively, the “Service”).

In these Terms, “Publisher”, “we”, “us”, and “our” mean the person or legal entity that operates and publishes BreakLoop and is identified in the Legal Notice available on the BreakLoop website. You can contact the Publisher at support@getbreakloop.app.

By accessing or using the Service, creating an account, joining a beta, or making a purchase, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use BreakLoop, or older if a higher minimum age is required by the law applicable to you.

You must also have the legal capacity to enter into these Terms. BreakLoop is not intended for children.

2. What BreakLoop is

BreakLoop is a smoking-cessation and wellness tool intended to help people understand and change their smoking behavior through features such as personalized reduction plans, cigarette tracking, pledges, craving tools, exercises, reflections, progress tracking, and related educational or motivational features.

BreakLoop is not a medical device, healthcare provider, medical treatment, emergency service, or substitute for professional medical advice, diagnosis, or treatment. Information, recommendations, plans, estimates, reminders, exercises, and other content provided through BreakLoop are for general wellness and informational purposes.

You should seek advice from a qualified healthcare professional when appropriate, including if you have questions about nicotine dependence, withdrawal symptoms, medications or nicotine-replacement products, pregnancy, mental or physical health conditions, or whether a particular cessation approach is appropriate for you.

If you believe you are experiencing a medical emergency, contact your local emergency services.

3. No guaranteed outcome

BreakLoop cannot and does not guarantee that you will quit smoking, reduce your smoking by any particular amount or by any particular date, avoid relapse, save a particular amount of money, experience a particular health outcome, or achieve any other result.

Plans, projections, savings figures, dates, milestones, and similar outputs may be based on information you provide and assumptions used by the Service. They are estimates, not promises.

You remain responsible for your decisions and actions.

4. Anonymous use and accounts

BreakLoop may allow you to use parts of the app without creating an account. Anonymous use may store your smoking, onboarding, plan, and progress information locally on your device rather than backing it up to your BreakLoop account.

You may also create or sign into an account using supported authentication methods. Account functionality is provided in part through third-party authentication services.

You are responsible for maintaining the security of your device and account credentials and for activity carried out through your account to the extent reasonably within your control.

Account-bound purchases and deletion

Some purchases and entitlements are bound to a specific BreakLoop account or billing identity.

If you voluntarily delete a signed-in BreakLoop account, account-bound data and entitlements — including Lifetime Access — may be permanently severed from that account and may not be restorable, even if you later create a new account using the same email address or sign-in provider. BreakLoop will provide a warning before completing account deletion where reasonably practicable.

Deleting your BreakLoop account does not automatically cancel an App Store subscription. App Store subscriptions must be cancelled through Apple.

Nothing in this section limits rights you cannot waive under applicable law.

5. Premium access

BreakLoop may offer free functionality and one or more paid premium tiers, including BreakLoop Pro.

The number, name, content, price, duration, trial availability, and future availability of plans or tiers offered to new purchasers may change at any time. We may introduce, modify, replace, discontinue, or stop offering a plan or purchase option, subject to applicable law and any rights already acquired by existing customers.

Premium access may be offered through recurring App Store subscriptions or through eligible direct web purchases.

6. App Store subscriptions

Subscriptions purchased through Apple's App Store are billed, renewed, cancelled, and refunded through Apple and are subject to Apple's applicable purchase, subscription, billing, and refund terms.

The price, billing period, renewal terms, free or discounted trial terms, and other purchase details shown by Apple at the time of purchase form part of the applicable transaction terms.

Unless Apple's terms or applicable law provide otherwise, cancelling an App Store subscription stops future renewal and does not normally end already-paid access before the end of the then-current billing period.

You can manage or cancel an Apple-billed subscription through your Apple Account. Apple's current cancellation guidance is available at https://support.apple.com/118428.

Refund requests for Apple-billed transactions are handled by Apple. See the BreakLoop Refund & Cancellation Policy for more information.

7. Lifetime Access and Early Access purchases

From time to time, BreakLoop may offer a limited direct web purchase that grants Lifetime Access to BreakLoop Pro.

What “Lifetime Access” means

“Lifetime Access” means access to BreakLoop Pro for the commercial lifetime of the BreakLoop service/product, subject to these Terms. It does not mean the lifetime of the purchaser or any other individual.

Early Access

Lifetime Access may be sold during an Early Access period before BreakLoop becomes publicly available on the App Store.

Your Lifetime Access entitlement is created after a successful purchase. If BreakLoop has not yet been publicly released, actual use of the app may require access to an available beta or TestFlight build. Beta capacity may be limited. If beta capacity is unavailable, your Lifetime Access remains associated with your eligible account, but you may need to wait until public App Store availability to use it.

Early Access pricing is promotional and reflects an early stage of the product. We do not guarantee that an Early Access price will be the lowest price BreakLoop ever offers. Future promotions, regional pricing, temporary offers, bundles, or other purchase options may be cheaper. A later lower price does not by itself create a right to a price adjustment or refund.

We may change the price, quantity, availability, or structure of Lifetime Access offers for future purchases, or stop selling Lifetime Access entirely, at any time. Stopping future sales does not cancel valid Lifetime Access already purchased.

Direct web purchases are subject to the BreakLoop Refund & Cancellation Policy.

8. Reasonable use of Lifetime Access

Lifetime Access is intended for ordinary personal use of BreakLoop.

It does not permit automated, abusive, fraudulent, excessive, or disproportionate use of BreakLoop infrastructure; attempts to provide access to other people; resale or sharing of an entitlement; circumvention of technical limits; or use that materially threatens the security, availability, integrity, or cost structure of the Service.

We may apply reasonable technical or usage safeguards to protect the Service and its users.

9. Beta and TestFlight access

BreakLoop may provide beta, preview, prerelease, or TestFlight versions of the Service.

Beta software may be incomplete, unstable, contain bugs, behave unexpectedly, experience downtime, and change substantially. Features may be added, changed, or removed. Where reasonably necessary for development, security, compatibility, or testing, beta data or beta environments may need to be reset.

Beta access may be limited by capacity, eligibility, technical requirements, Apple TestFlight availability, or other operational constraints. We may suspend or withdraw beta access at any time.

A user may have valid paid BreakLoop access and also choose to use a beta or TestFlight version when available.

Apple TestFlight and related Apple services are separately subject to Apple's terms.

10. Changes to BreakLoop

BreakLoop is an evolving service. We may update, improve, redesign, replace, add, remove, or discontinue features when reasonably necessary or useful for reasons such as security, legal compliance, platform changes, technical development, product improvement, abuse prevention, cost, or changes in third-party services.

For consumers, changes to continuously supplied digital products remain subject to any mandatory rights under applicable law. Where applicable law requires advance notice, a valid reason, continued access, termination rights, or another remedy, those rights apply.

Nothing in these Terms permits us to remove mandatory consumer rights.

11. Loss of Premium access and stored data

When Premium access expires or is lost, premium functionality may become unavailable while your existing local data and progress remain available where technically supported.

Cloud-backed BreakLoop app data may be automatically deleted after approximately 12 months without Premium access, unless you delete it earlier or applicable law requires a different retention period. Certain limited account, entitlement, transaction, fraud-prevention, or legal records may be retained separately as described in the Privacy Policy.

Where available, you may request deletion of signed-in app data from the Account controls accessible through the app's welcome screen after authentication.

12. Feedback and user-submitted content

BreakLoop may include a feedback area where users can report bugs, request features, comment on ideas, or provide other product feedback. Content intentionally submitted to a public or shared feedback area may be visible to other BreakLoop users and may later also be displayed on the BreakLoop website.

Do not include private, confidential, medical, or other sensitive information in public feedback.

You retain any rights you have in feedback you submit. By submitting feedback, you grant the Publisher, to the extent permitted by applicable law and subject to applicable data-protection rights, a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, transferable, and sublicensable licence to host, reproduce, adapt, publish, translate, distribute, display, and otherwise use that feedback for operating, improving, developing, documenting, marketing, and supporting BreakLoop and related products, without compensation to you.

You represent that you have the rights necessary to submit the content you provide.

We may moderate or remove feedback content that is unlawful, abusive, misleading, infringing, spam, unsafe, or otherwise inappropriate.

13. Sharing achievements

BreakLoop may allow you to share achievements, badges, milestones, or similar information through your device's sharing features or third-party apps.

Sharing is initiated by you. Once you choose to share information outside BreakLoop, the recipient platform or person may copy, store, redistribute, or otherwise use it under terms we do not control. You are responsible for deciding what to share and with whom.

You must not, except where applicable law expressly permits the activity despite these restrictions:

We may restrict, suspend, or terminate access where reasonably necessary because of:

Where the circumstances allow, we may provide notice or an opportunity to stop the violation. We may act immediately where delay could reasonably expose BreakLoop, users, third parties, or infrastructure to fraud, abuse, loss, or security risk.

Lifetime Access may be terminated for fraud, material breach, abusive use, or other serious misuse covered by this section. A user whose access is terminated because of abuse is not entitled to a refund solely because of that termination, except where applicable law requires otherwise. Fraud-related refunds or reversals will be handled as required by law and the applicable payment provider.

If the BreakLoop service reaches the end of its commercial lifetime and is permanently discontinued for all users, Lifetime Access ends with the Service, subject to any mandatory consumer rights that apply at that time.

16. Intellectual property

The Service, including its software, interface, design, branding, graphics, text, audiovisual material, algorithms, exercises, and other Publisher-provided content, is owned by or licensed to the Publisher and is protected by intellectual-property and other applicable laws.

Except for the limited rights expressly granted under these Terms and Apple's applicable licence terms, no right, title, or interest in BreakLoop is transferred to you.

“BreakLoop” and associated branding may not be used in a way that suggests endorsement, partnership, or affiliation without permission.

17. Apple App Store terms

For BreakLoop obtained through Apple's App Store, Apple states: “Apps made available through the App Store are licensed, not sold, to you.”

Your licence to the iOS application is governed by Apple's current Licensed Application End User License Agreement (Standard EULA), unless Apple or the Publisher expressly provides a valid Custom EULA for the application.

These BreakLoop Terms govern the BreakLoop account, Service, website, premium functionality, Publisher-provided content and services, beta access, direct purchases, and other matters not exclusively governed by Apple's app licence.

These Terms are intended to supplement, not replace, Apple's Standard EULA with respect to an App Store copy of BreakLoop. If these Terms conflict with Apple's Standard EULA on a matter specifically governing the App Store licence, Apple's Standard EULA controls to the extent of that conflict.

Apple is not responsible for providing BreakLoop support except to the extent required under Apple's own terms or applicable law.

18. Third-party services

BreakLoop relies on third-party platforms and providers for functions such as authentication, cloud infrastructure, billing, payments, analytics, email delivery, App Store distribution, and beta distribution.

Those services may be subject to separate terms and privacy policies. We are not responsible for third-party services to the extent their operation is outside our reasonable control, except where applicable law provides otherwise.

The unavailability or change of a third-party service may require us to modify how a BreakLoop feature works.

19. Disclaimers

To the maximum extent permitted by applicable law, BreakLoop and the Service are provided “as is” and “as available.”

We do not warrant that the Service will always be uninterrupted, error-free, secure, compatible with every device or operating-system version, or free of defects, or that every feature will remain available forever.

Nothing in these Terms excludes any warranty, guarantee, conformity right, or other consumer protection that cannot lawfully be excluded.

20. Limitation of liability

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability for intentional misconduct, gross negligence, injury to life, body, or health, or liability under mandatory product-liability rules.

Where the Publisher is liable for slight negligence, liability is excluded except for breach of an essential contractual obligation whose performance is necessary for the proper performance of the agreement and on whose performance you may ordinarily rely. In that case, liability is limited, to the extent permitted by law, to the foreseeable damage typical for this type of agreement.

To the maximum extent permitted by law, the Publisher is not liable for indirect, incidental, special, punitive, or consequential loss; lost profits; lost business; or loss of data resulting from circumstances outside the Publisher's reasonable control.

BreakLoop's wellness estimates, smoking plans, projections, savings calculations, reminders, and educational content do not create liability merely because an individual result differs from an estimate or expectation.

The limitations in this section also apply for the benefit of the Publisher's employees, contractors, representatives, and agents where legally permissible.

21. Indemnity for misuse

To the extent permitted by applicable law, you are responsible for losses, claims, or reasonable costs arising from your intentional or culpable unlawful misuse of the Service, infringement of another person's rights, or material violation of these Terms.

This section does not create liability for lawful consumer use or override mandatory consumer protections.

22. Changes to these Terms

We may update these Terms to reflect changes to BreakLoop, law, security requirements, billing arrangements, third-party services, or our business.

If a change materially affects an existing paid user's contractual rights, we will provide notice where required by law and will not rely on these Terms to remove rights that applicable law requires us to preserve.

The version identified by the “Last updated” date applies from its stated effective date.

23. Governing law and disputes

These Terms and the relationship between you and the Publisher are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods, to the extent applicable.

If you are a consumer, this choice of law does not deprive you of mandatory protections granted by the law of the country in which you have your habitual residence where those protections apply regardless of the chosen law.

For consumers, jurisdiction is determined by applicable law. Nothing in these Terms requires a consumer to submit a dispute to mandatory private arbitration.

For users who are merchants, legal entities under public law, or special funds under public law, and where legally permitted, the courts at the Publisher's place of establishment in Germany shall have jurisdiction.

The Publisher does not voluntarily commit to participate in consumer dispute-resolution proceedings before a consumer conciliation body unless required by applicable law or expressly agreed in a particular case.

24. Severability and no waiver

If a provision of these Terms is invalid or unenforceable, the remaining provisions remain effective to the extent permitted by law. Mandatory statutory rules apply in place of an invalid provision where required.

A failure to enforce a provision on one occasion does not waive the right to enforce it later.
